Assumption of responsibility

THE SALE OF ALCOHOLIC PRODUCTS IS PROHIBITED TO MINORS.
Users of www.tenutadelcastello.it declare that they are of legal age according to the legislation applicable to them. If there is no legislation in this regard, you must be at least 21 years old.
The responsibility for browsing the site is entirely the responsibility of the User. The 'Administrator disclaims any warranty, whether express or implied, in relation to the Site and its content, including in terms of completeness, accuracy and quality. Privacy: information art. 13 Legislative Decree 196/2003.


Acceptance of the General Conditions of Sale

Orders are accepted through the electronic shopping cart on the website of www.tenutadelcastello.it. The order placed by the customer is subject to acceptance by Tenuta del Castello società agricola srl. The customer who sends the order via the Internet will receive, at the end of the procedure, a communication of confirmation from the order, by electronic mail (E-mail), indicating the relevant order number and relevant link to follow the status of his order. At the time of sending the order, a contract of sale is concluded and the Customer, by placing the order, declares that he has read all the information provided to him and fully accepts the general and payment conditions transcribed below. N.B: If you change your mind and want to cancel your order, you are kindly requested to notify us promptly by email to: amministrazione@tenutadelcastello.it

If the Customer is a natural person who purchases the goods for purposes not related to his professional activity, once the online purchase procedure is completed, he must print or save an electronic copy and keep these general conditions of sale, in accordance with the provisions of Article 49 of DL 206/2005 on distance selling.


Product Availability

In the product catalog published at www.tenutadelcastello.it, product availability, even being constantly updated, may change NOT IN REAL TIME and without notice. For organizational reasons, the tally on product availability is updated after packing.

Orders placed by individuals acting within the scope of their profession or businesses must authenticate themselves as such when placing the order. If they do not do so, orders are considered to be placed by consumers.
The Customer can purchase the products, which can be viewed and described, on the site www.tenutadelcastello.it bearing in mind that the pictures of the products may not be perfectly representative of their characteristics but may differ in color, size, accessory products in the picture. Information on the individual product is collected in the TECHNICAL SHEETS that can be consulted from the site itself and downloaded in pdf format. 
Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order or cancellation due to non-payment within the established term of an order.
If the products ordered are in stock, the order will be shipped immediately upon receipt of payment for the order. Should some products within an order exceed availability in the warehouse, you will be contacted by email from Castle Estate to provide the estimated delivery time for delivery of the ordered material.
Should the payment be made by bank transfer, please note that the shipment will take place only after receiving the payment of the order with the corresponding currency.


Prices

All prices displayed on the detail pages at www.tenutadelcastello.it are presented with both VAT included and VAT excluded.
VAT is charged at the rate of 22% on most items. However, the detail page specifies the tax rate.
The shipping cost is added up on the order confirmation page. Shipping prices may be changed at any time without notice.


Mode of Purchase

Receipt of the order is confirmed by sending, automatically, an e-mail to the Customer's e-mail address, with all the details of the order placed, order number, date, products purchased, total amount to be paid, registration address and if different from the registration address the shipping address. The Customer must verify the accuracy of the data and communicate any corrections.

The sending of the confirmation e-mail for the receipt of the order is made, always, subject to acceptance of the order by Tenuta del Castello. In case of non-acceptance of the order, immediate notice will be given.

For the products sold, an invoice is issued for those who have identified themselves as a company with VAT number. The data for the issuance of the invoice and for its sending will be those indicated by the Customer at the time of registration; it will be the responsibility of the customer to notify Tenuta del Castello by email at amministrazione@tenutadelcastello.it of any changes. No changes in the invoice will be possible, after its issuance.

 

Right of Withdrawal - Returns Management

Information on the right of withdrawal
Purchases on the site tenutadelcastello.it are subject to the discipline of Legislative Decree 206/2005 and Legislative Decree 21/2014, which guarantees the right to withdraw, for any reason, from the purchase contract.

Conditions of the right of withdrawal (in accordance with dlgs 206/2005 mod. D.Lgs. 21/2014)
You have the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods.

Mode
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an explicit statement, such as a letter sent by e-mail to amministrazione@tenutadelcastello.it.
In your private area of the site, under "my orders," you will find the RETURNS section, with procedures to follow.
To meet the withdrawal period, it is sufficient for you to send the notice regarding the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal
If you withdraw from this contract, you will be refunded the relevant payment you have made to us, without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from this contract. Refunds may be withheld beyond 14 days only until you have demonstrated that you have returned the goods or until they have been received by us, whichever occurs first. Said refunds will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise.
You are responsible only for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics, and operation of the goods.

You will be responsible for the direct costs of returning the goods. The purchased goods must be substantially intact; we recommend that you take the utmost care in preparing the package, such as using the original packaging.

Exclusions to withdrawal
The right of withdrawal is excluded in the following cases under Article 59 of the Consumer Code:
- the supply of custom-made or clearly customized goods
- the provision of sealed goods that are not suitable for return for hygienic or health protection-related reasons and have been opened after delivery;
- the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;


Legal warranty for lack of conformity

Non-compliant wine
Non conforming wine refers to wines that exhibit characteristics that differ from the producer's quality standards. Examples include, but are not limited to, the typical "corky" smell and taste, rather than leaking liquid or a label completely ruined in transit.
When the wine is non-compliant it can be replaced, provided it is still available, at no cost to the customer. If the wine is no longer available, the amount spent is refunded.
From the moment the customer detects an alleged nonconformity, he or she must report the alleged nonconformity of one or more bottles via e-mail to amministrazione@tenutadelcastello.it within 24 months of purchase and no later than two months from the discovery of the defect. The report must be accompanied by the order number, as well as a description of each individual bottle believed to be non-conforming and the non-conforming quantity. 
In this way Tenuta del Castello will arrange, through its own courier, a free pickup at the address indicated in the email.
The product(s) must be returned with at least 2/3 of the original contents and sealed with the original cap properly trimmed. The return package must be given to the courier in the original packaging to protect the transport of the wine. Once the wine is returned and evaluated for nonconformity, a new shipment of bottles of the same type and vintage is immediately arranged, if still available, or a refund of the amount spent is immediately made.

After filling the shopping cart with the desired products and quantities, you will be able to choose your preferred payment method.
Payment must be made and communicated within 5 calendar business days of receiving your order confirmation otherwise it will be considered void.
The days required to process your order will start from the time of payment.
Please note: If you have chosen to pay by Advance Bank Transfer or PayPal, Tenuta del Castello will wait to ascertain the credit before shipping the goods. 


Shipping

How do we handle our shipments?
After completing your order it will remain in processing for up to two business days. When your package is ready it will be shipped and you will receive an email confirmation. Please note that couriers do not deliver by appointment and there is no telephone contact. Standard delivery is between 3 and 5 business days, to be calculated from the time the package leaves our warehouse (weekends and holidays excluded). 

With whom do we make our shipments?
The courier company that Tenuta del Castello relies on for shipments in Italy is GLS, a leading company in Italy and therefore chosen by us because of the excellence and reliability of their services.
